Terms of Use

Terms of use for the James Plumbing & Heating website, service requests, chat assistant, and customer communications programs including SMS, email, and calls.

These Terms of Use (“Terms”) are an agreement between you and James Plumbing & Heating, Inc. (“James Plumbing & Heating,” “Company,” “we,” “our,” or “us”) for your use of jamesplumbingandheating.com (the “Website”) and related online services, including the service-request form, the chat assistant, and our customer communications programs.

By using the Website, submitting a request, starting a chat, or providing your contact information, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Website or enroll in any program.

1. The Website

The Website is an informational site for James Plumbing & Heating, a licensed plumbing, heating, and cooling contractor serving Santa Fe, Los Alamos, Española, and nearby Northern New Mexico communities. It describes services, service areas, projects, reviews, and articles, and it lets you request a callback or visit.

Content is provided for general information. It is not a substitute for an on-site inspection, a licensed technician’s diagnosis, or a written proposal. Emergency conditions (active leaks, flooding, sewage backup, no heat in freezing weather, or a gas smell) require an immediate phone call to (505) 473-7148 or, where appropriate, 911 or the gas utility.

2. Service requests, estimates, and scheduling

Submitting the Website form or asking the chat assistant to send a service request is a request for contact. It is not a contract for work, a guaranteed appointment, or an accepted estimate. We may follow up by phone, email, or text to confirm details, coverage, timing, and price before work is scheduled.

Any estimate, scope, or price we later provide is an offer that becomes a service agreement only if we and you accept it through our ordinary scheduling and authorization process. Work performed at a property is subject to those later terms, applicable licenses, and New Mexico law—not solely these Website Terms.

You agree that information you submit is accurate to the best of your knowledge, that you are authorized to request service for that property, and that you will not send payment card numbers or other sensitive records through the Website.

3. Chat assistant

The Website may offer an AI chat assistant. Replies are generated automatically, may be incomplete, and are not a substitute for a licensed plumber or HVAC technician. The assistant can collect a service request and send it to the company; it cannot dispatch a technician, bind a price, or create a warranty.

Messages you send in chat are stored so staff can review them. Do not share payment information or other sensitive records in chat.

4. Acceptable use

You agree not to:

  • Use the Website for any unlawful purpose, or to submit false, misleading, or harassing requests.
  • Attempt to probe, scan, or disrupt the Website, the chat assistant, or related systems.
  • Scrape, harvest, or automate access except through documented public pages a browser would load.
  • Impersonate another person or submit another person’s contact information without authority.
  • Upload malware or interfere with other visitors.

We may refuse, block, or delete submissions that appear abusive, fraudulent, or harmful, and we may report illegal activity.

5. Intellectual property

The Website’s design, text, logos, photographs, and software are owned by James Plumbing & Heating, Inc. or its licensors. You may view and print pages for personal, non-commercial use related to requesting our services. You may not copy, republish, or commercially reuse site content without our written permission, except for brief quotations with attribution.

6. Third-party sites and tools

The Website may link to or embed third-party services, including Google Maps and Facebook. Those services are governed by their own terms and privacy policies. We are not responsible for their content or practices.

7. Disclaimers

THE WEBSITE AND THE CHAT ASSISTANT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Website will be uninterrupted, error-free, or free of harmful components, or that published hours, coverage, or service descriptions are complete at every moment.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JAMES PLUMBING & HEATING, INC. AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE WEBSITE, THE CHAT ASSISTANT, OR A COMMUNICATIONS PROGRAM.

OUR TOTAL LIABILITY ARISING OUT OF THE WEBSITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100), EXCEPT FOR LIABILITY THAT CANNOT BE LIMITED UNDER NEW MEXICO LAW. This section does not limit liability for on-site plumbing or HVAC work performed under a separate service agreement.

9. Indemnity

You agree to indemnify and hold harmless James Plumbing & Heating, Inc. and its owners, employees, and contractors from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Website, your submitted content, or your violation of these Terms.

10. Customer communications programs

James Plumbing & Heating, Inc. operates one or more text messaging, email, and call programs (collectively, the “Programs”) to communicate with customers and prospects regarding our services. These Programs may include, without limitation:

  • Service-related alerts and reminders.
  • Customer support and scheduling updates.
  • Post-project follow-up communications, including satisfaction surveys, Net Promoter Score (NPS) collection, qualitative feedback about completed work, and invitations to leave public reviews on third-party platforms.
  • Where permitted, limited informational or promotional messages related to our services.

By providing your contact information (including your mobile phone number and email address) and opting in to receive messages from us through an affirmative act, you agree to the Program terms in this section and our Privacy Policy. Merely visiting or using the Website does not enroll you in a Program. If you do not agree, please do not opt in.

Providing contact information or using the Website without that affirmative act does not enroll you.

Message frequency, charges, and carrier delivery

Consent to receive marketing or promotional messages is not a condition of purchasing services.

  • Message frequency may vary based on your interactions with us and the programs you join.
  • Message and data rates may apply. You are responsible for charges under your mobile plan.
  • Carriers are not liable for delayed or undelivered messages.

Opting out or getting help

Reply STOP to any text message to opt out. We may send one confirmation message, after which you will no longer receive text messages from that program unless you opt in again.

Reply HELP to any text message for help, or contact us using the information on this page. You may also contact us directly to ask us to stop sending messages by SMS, email, or phone.

Mobile information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. We do not sell, rent, or share your mobile phone number, text-message consent information, or opt-out status with third parties or affiliates for their own marketing or promotional purposes. We may share this information only with service providers that help us deliver text messages or as required by law.

Post-project survey and review requests

After a project or service is completed, we may contact you by phone, SMS/MMS, or email to:

  • Request that you complete a satisfaction survey.
  • Collect a Net Promoter Score (NPS) or other rating regarding your experience.
  • Gather qualitative feedback about the work that was performed.
  • Ask you to leave a review on public platforms (such as online review or social media sites), at your discretion.

Your participation in surveys, feedback requests, or public reviews is voluntary. Declining to participate will not affect your ability to receive services from us.

12. Governing law

These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules. Courts located in Santa Fe County, New Mexico, have exclusive jurisdiction over disputes arising from the Website or these Terms, except that we may seek injunctive relief in any jurisdiction to protect our intellectual property or confidential information.
